Applicable Laws

Charleston USA Immigration Law Center controls the design and operation of this website from our offices in Charleston, South Carolina and our website designers offices in Valencia, California. These terms and conditions and all other content on this website and all relationships between the user and us are governed by the laws of the state of South Carolina with all disputes having jurisdiction in Charleston, South Carolina.

Miscellaneous Provisions

If any provisions of these Terms and Conditions and all other content on this website shall be found to be unlawful, void or unenforceable for any reason, such provision shall be revised to the minimum extent required by law.

You agree that if any dispute, controversy or claim arises under the Terms and Conditions and all other content on this website, either party may request, upon written notice to the other party, Facilitated Negotiation. Such negotiation shall be assisted by a neutral facilitator acceptable to both parties and shall require the best efforts of the parties to discuss in good faith the conflict, their respective positions toward their differences to finally resolve their dispute and conducted first at the offices of Charleston USA Immigration Law Center and second at the offices of the facilitator, but within Charleston County, South Carolina.

Each party agrees to disclose all facts to the other party or to the facilitator, which, in good faith, the facilitator deems necessary to resolve the dispute. All disclosures of fact to the facilitator shall be in furtherance of settlement efforts and will not be admissions of fact for any litigation or Binding Arbitration purposes. Except as agreed by both parties, the facilitator shall keep confidential all information disclosed during negotiations. The facilitator shall not act as a witness for either party or any party in any subsequent arbitration or legal proceeding.

Such Facilitated Negotiation shall conclude within forty five days from receipt by the facilitator of instruction to facilitate unless mutually extended, in writing by all parties. The costs incurred by each party will be borne by it and the fees and expenses of the facilitator shall, if any, shall be borne equally by the parties.

If any dispute, controversy or claim arises under the Terms and Conditions and general content of this website cannot be resolved by Facilitated negotiation then such dispute, controversy or claim shall be settled by Binding Arbitration in Charleston County, South Carolina.

Such arbitration shall be conducted by a panel of three persons, one chosen by each party and the third chosen by the other two arbitrators chosen for the panel. The panel shall have no authority to award non monetary or equitable relief or punitive damages. The parties shall equally be responsible for the fees and costs of the Arbitrators, if any. As a condition of arbitration the arbitrators and parties agree to keep confidential all aspects, including awards of the arbitration panel.

Arbitration shall otherwise be conducted under the guidelines of the American Arbitration Association but not through such Association.
