L-1 Visa, Intracompany Blanket Petition Program
The Intercompany Blanket Petition Program has been implemented by the USCIS to enable larger multinational U.S. and foreign companies to file one petition to temporarily transfer many managerial/executive employees under the L-1A visa non-immigrant category or many professional employees with specialized knowledge under theL-1B visa category.
Eligible companies must demonstrate:
- The petitioner has an active office in the U.S. for the previous year,
- The petitioner has 3 or more domestic and foreign branches, subsidiaries and affiliates,
- The petitioner and each of its qualifying organizations are engaged in commercial trade or services,
- They have obtained 10 or more L-1 approvals in the past 12 months or they have combined annual sales of at least 25 million dollars or they have 1000 or more combined employees.
L-1 Visa Submission Process
The petitioner will appropriately file its Blanket Petition, with all accompanying documents and pay all required filing fees including any fraud prevention, detection and Border Security Act fees. Thereafter, the petitioner will forward a copy of the Blanket Approval Notice, along with USCIS Form I-129S and all other required documentation to the employee who will present it to the U.S. Embassy or Consulate for visa processing. Canadians may have special procedures in this regard.
