This is a procedure whereby the spouse and child(ren) of a permanent resident elect not to accompany a permanent resident to the U.S. upon approval of its petition based upon family, employment or the diversity visa lottery and then elect to join the petitioner at a later date. It is not eligible for immediate relative based petitions. The spouse and child(ren) must have been family of the permanent resident by birth, marriage or adoption, at the time of its approval and the child(ren) must be unmarried and under 21 years of age.
Submission Process
Application is made on USCIS Form I-824, with all accompanying documentation and paying all required filing fees. Then interviews will be scheduled for home U.S. Embassy or consular processing and additional visa processing fees will be due at that time.
